BRAZIL: DEPUTY WANTS TO LEGALIZE "THEFT BY NEED"
Federal Deputy Talíria Petrone (PSOL-RJ) presented a bill (PL) that, in short, decriminalizes food theft. Proposal amends article 155 of the Penal Code and provides for alternative punishments.
Bill of Law 4540/2021 is already filed with the Chamber of Deputies and provides for the amendment of the Penal Code. As a result, the prison would be prohibited in cases of theft of food and products considered essential.
Thus, the new text of Article 155 should contain the terms “theft out of necessity” and “insignificant theft” – with light punishment, only fines, depending on the specific case.
The document also provides that there is no crime in recidivism situations.
